Data Recovery Service Terms and Conditions

1. General Provisions

1.1. These Terms and Conditions govern the relationship between the Client (hereinafter referred to as the “Client”) and the data recovery service provider (hereinafter referred to as the “Service Provider”).

1.2. By submitting an order, the Client confirms that they have read, understood, and agree to be bound by these Terms and Conditions.

2. Scope of Service

2.1. The Service Provider performs recovery of damaged, formatted, or deleted data from various types of data carriers, including but not limited to hard drives, solid-state drives (SSDs), memory cards, and mobile devices.

2.2. The outcome of data recovery depends on the nature of the damage and the condition of the data carrier. The Service Provider does not guarantee full or successful data recovery.

3. Diagnostics and Pricing

3.1. Prior to commencing any recovery work, the Service Provider conducts diagnostics to determine the type and extent of the damage and to assess the potential for data recovery.

3.2. Following the diagnostics, the Client will receive a service proposal outlining the estimated cost and the expected recovery results.

3.3. If the Client declines to proceed with the recovery after diagnostics, only the diagnostic fee will apply.

3.4. In cases where data cannot be recovered, the Client is charged solely for the diagnostics.

4. Data Security and Confidentiality

4.1. All Client data are handled with strict confidentiality and are never disclosed to third parties without the Client’s explicit consent, except where required by law.

4.2. After the recovered data have been delivered to the Client, the Service Provider retains a copy of the recovered data for up to seven (7) calendar days, after which the data are permanently and irreversibly deleted.

5. Limitations

5.1. Data recovery services cannot repair existing file corruption or restore information that has been permanently destroyed or overwritten.

5.2. Recovered files may be partially damaged or inaccessible.

5.3. The Service Provider assumes no responsibility for the content, quality, or value of the recovered data.

6. Client Responsibilities

6.1. The Client represents and warrants that they are the lawful owner of the submitted data carrier and are authorized to allow the Service Provider to access and process the data contained therein.

6.2. The Client acknowledges that certain recovery procedures may irreversibly alter the physical or logical condition of the data carrier (for example, chip-off extraction or other invasive techniques).

6.3. The Client agrees to pay all applicable service fees and, if required, any associated data carrier return shipping costs.

7. Ownership of Data Carriers

7.1. The Client must collect their data carrier within thirty (30) calendar days following completion of the service.

7.2. If the Client fails to settle the service fees and/or collection costs within this period, and the data carrier is not retrieved, ownership of the carrier shall automatically transfer to the Service Provider.

7.3. Upon transfer of ownership, the Service Provider reserves the right to dispose of the data carrier and permanently destroy all data contained therein.

8. Limitation of Liability

8.1. The Service Provider shall not be liable for any direct or indirect damages, losses, or expenses incurred by the Client as a result of data loss, including but not limited to financial, commercial, or emotional losses.

8.2. The Service Provider’s total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the Client for the specific service in question.

9. Final Provisions

9.1. These Terms and Conditions take effect at the moment the Client submits a data carrier to the Service Provider.

9.2. Any disputes arising from or related to these Terms shall be resolved amicably through negotiation. If an agreement cannot be reached, the dispute shall be settled in accordance with the laws and regulations of the Republic of Latvia.
